Driver Qualification Files in 2026: What Every Small Carrier Is Missing and Why It Matters
· Trucking Compliance Service
Driver Qualification files are the single most cited deficiency during FMCSA compliance reviews in 2026. When an auditor walks into your office or pulls your records remotely, DQ files are the first thing they ask for. And in the majority of small carrier audits, something is missing, expired, or was never collected in the first place.
The problem is not that carriers don’t care about DQ files. It is that most owner-operators were never properly trained on exactly what a complete, legally compliant DQ file contains, how long each document must be retained, and what happens the moment a single required item is missing during an audit.
What Must Be in Every Driver Qualification File
Under FMCSA regulations at 49 CFR Part 391, every driver operating a commercial motor vehicle under your authority must have a complete Driver Qualification file maintained by the carrier. The required contents are:
- Application for employment: A signed application completed before the driver operated any CMV, even if the driver is the owner-operator themselves
- Motor Vehicle Record (MVR) from all states: An MVR must be obtained from every state where the driver held a license in the past three years, pulled within 30 days of hiring
- Annual MVR review: A new MVR must be pulled every 12 months and a written annual review of the driver’s record must be completed and signed
- Road test certificate or equivalent: Documentation that the driver passed a road test in the type of vehicle they operate, or an equivalent waiver such as a CDL
- DOT medical examiner’s certificate: Current, valid medical certificate issued by a licensed Medical Examiner listed on the FMCSA’s National Registry
- Previous employer safety performance history: Written requests to all DOT-regulated employers in the past three years asking about accidents and drug and alcohol violations, plus the responses received
- Drug and Alcohol Clearinghouse query results: Pre-employment full query result and annual limited query results for every year the driver has been employed
The Items That Are Almost Always Missing
Based on compliance reviews across hundreds of small carriers, certain DQ file items are consistently missing or incomplete. If you are reviewing your own files right now, pay particular attention to these:
- Previous employer inquiries: Most carriers send the request but never follow up when they receive no response. The regulation requires you to document attempts to contact and retain whatever response you do or do not receive.
- Annual review documentation: Pulling an MVR is only half of the requirement. The regulation also requires a written annual review signed by someone at the carrier. Many carriers pull the MVR but never complete the written review.
- Medical certificate updates: When a driver renews their medical certificate, the new certificate must be added to the DQ file and the old one retained. Files with only the most recent certificate and no history of prior certificates are technically incomplete.
- Clearinghouse records: This is now a required DQ file component and many carriers who built their files before the Clearinghouse existed have never added these records.
What Happens When Your DQ Files Are Incomplete
During a compliance review, missing or incomplete DQ files result in violations that are scored against your carrier profile. Depending on the number of deficient files and the severity of what is missing, the auditor can rate your carrier as Conditional or Unsatisfactory. An Unsatisfactory rating can trigger an imminent hazard shutdown order that prevents you from operating until the issues are corrected and an upgraded rating is issued.
Even a Conditional rating affects your ability to work with premium shippers and brokers and can trigger follow-up audits within 60 days.

Frequently Asked Questions
1. Does an owner-operator need a DQ file on themselves?
Yes. If you hold a CDL and operate a CMV under your own MC Authority, you are required to maintain a Driver Qualification file on yourself just as you would for any employee driver. This includes completing a self-application, pulling your own MVR, completing annual reviews, and maintaining your medical certificate in the file. Many owner-operators do not realize this requirement applies to them personally.
2. How long must DQ files be retained?
DQ files must be maintained for the entire period of the driver’s employment and for three years after the driver leaves. Medical examiner certificates must be retained for three years from the date of the examination. Annual MVR reviews must also be retained for three years. These retention requirements apply even if your business closes.
3. Can I keep DQ files electronically?
Yes. FMCSA regulations allow Driver Qualification files to be maintained electronically as long as the electronic system accurately reproduces all documents in their original form, allows for immediate retrieval during an audit, and protects the integrity and authenticity of the records. Any electronic system used must also provide a method to identify the person who made entries and the date and time of any modifications.
